Understanding the Social Security Appeals Process

The Social Security System in Malta provides a variety of benefits to eligible citizens and residents, amongst them are the retirement pensions, unemployment benefits, and disability benefits. However, not every application for benefits is approved. If your application has been denied, you may be eligible to appeal the decision through the appeals process. Understanding the appeals process can help you prepare and provides you with the best chance of successfully overturning the decision.

If your application for benefits has been denied, you will receive a written decision explaining the reason for the rejection. If you disagree with the decision, you have the right to appeal. The first step in the appeals process is to request a reconsideration of the decision by the Social Security System. This request should be submitted in writing within thirty (30) days of the date of the decision.

The online form provides an appellant with the option to choose their preferred mode of participation between attending an in-person hearing or opting for an online hearing, based on their convenience and comfort level. This flexibility allows appellants to have greater control over their hearing experience and ensures that their needs are accommodated. Whether attending in person or online, this online form aims to provide an accessible and efficient way to facilitate the hearing  proceedings.

Once the details are vetted, a notification is sent to the appellant with the date, time and venue of the sitting in front of the umpire. If the appellant requested to join as an online hearing, a date, time and link to join the online hearing is sent by an email notification.

To prepare for the appeal hearing, it is important to gather all relevant information and documentation, including any evidence that supports your case. This may include medical records, employment records, and other documentation that demonstrates your eligibility.

During the appeals process, an independent appeals board will review the evidence and make a final decision on your case. The appeals board will take into account all relevant information, including the written decision, your request for reconsideration, and any additional evidence that you have put forward. The appeals board may also ask you to appear in person for the hearing to be able to reply to any questions and provide additional information.

Accordingly, if your application for social security benefits has been denied, the appeals process provides you with an opportunity to have your case reviewed by an independent appeals board. By understanding the process, preparing thoroughly, and presenting a compelling case, you can increase your chances of success in the appeals process.
